BUILDING WARRANTIES FOR NEW CONSTRUCTION HOMES IN SPAIN

As an owner of a new construction home in Spain, you are entitled to legal warranties. They provide you protection against possible financial damage caused by bankruptcy, construction errors, and defects in your new home.

This construction warranty is a legal requirement according to Article 1591 of the Spanish Civil Code and is also established in statute 38/1999 of the Spanish building regulation (LOE).

EVERY NEW CONSTRUCTION HOME COMES WITH A 10-YEAR WARRANTY (SEGURO DECENAL) THROUGH THE DEVELOPER

What warranties does your new construction home have?

1-YEAR WARRANTY

For material damage relating to the finish. For example, this could involve doors that are improperly adjusted, poor carpentry, minor electrical faults, or similar issues that do not prevent the occupation of the property but require intervention from those who participated in the construction of the property.

3-YEAR WARRANTY

For damage related to the habitability of the home, with the most common damage caused by moisture.

10-YEAR WARRANTY

For functional damage to the home. This means damage to the foundations, support beams, load-bearing walls, and other structural elements that endanger the mechanical strength and stability of the building.

A developer must also provide a guarantee, in case the home is not delivered, for example due to bankruptcy, to refund the amounts already paid by you plus interest.
